Without objection, CS FOR SENATE BILL NO. 178(FIN) An Act stating legislative intent regarding parking, maintenance, leasing, and other requirements for a certain building acquired by the state in downtown Anchorage; giving notice of and approving a lease- purchase agreement by the Department of Administration for an office building in Anchorage; relating to the financing of the lease- purchase agreement; and providing for an effective date was adopted and read the second time. Senator Halford offered Amendment No. 1 : 1997-05-05 Senate Journal Page 1682 SB 178 Page 1, line 3: Delete "a lease-purchase agreement" Insert "the purchase" Page 1, line 4: Delete "Department of Administration for" Insert "Alaska Housing Finance Corporation of" Page 1, lines 4 - 5: Delete "relating to the financing of the lease-purchase agreement;" Page 1, line 8: Delete "lease-purchase agreement" Insert "purchase" Page 1, line 9: Delete "agreement" Insert "purchase" Page 1, line 11: Delete "agreement is entered into" Insert "purchase is made" Page 2, lines 19 - 20: Delete all material. Renumber the following paragraphs accordingly. Page 2, line 25, through page 3, line 3: Delete all material and insert: "* Sec. 2. NOTICE AND APPROVAL OF BUILDING PURCHASE. The Alaska Housing Finance Corporation is authorized to purchase an office building in Anchorage, Alaska, under AS18.55.010 - 18.55.290. The building shall be leased to the state for the offices of state agencies other than the corporation. The maximum amount of the purchase price may not exceed $35,700,000, excluding lease buy-outs and other costs related to the purchase. This section constitutes the review and approval required by AS18.55.100(d)." Senator Halford moved for the adoption of Amendment No. 1. Senator Duncan objected. AS29.45.030(a)(1) is amended to read: (1) municipal property, including property held by a public corporation of a municipality, or state property, or land that is in the trust established by the Alaska Mental Health Enabling Act of 1956, P.L. 84-830, 70 Stat. 709, except that (A) a private leasehold, contract, or other interest in the property is taxable to the extent of the interest; (B) notwithstanding any other provision of law, property acquired by an agency, corporation, or other entity of the state through foreclosure or deed in lieu of foreclosure and retained as an investment of a state entity is taxable; this subparagraph does not apply to federal land granted to the University of Alaska under AS14.40.380 or 14.40.390, or to other land granted to the university by the state to replace land that had been granted under AS14.40.380 or 14.40.390; (C) an ownership interest of a municipality in real property located outside the municipality acquired after December 31, 1990, is taxable by another municipality; however, a borough may not tax an interest in real property located in the borough and owned by a city in that borough; (D) after the state purchases a building that is in existence when the purchase is made, the state shall pay the full amount of any property taxes levied on the building by a municipality;" Page 1, line 5: Delete "* Section 1." Senator Pearce moved for the adoption of Amendment No. 4.
